2019-11-18 Traffic volume:161

The Anti Monopoly Bureau of the State Administration for Market Regulation recently disclosed that the investigation into Lenovo's monopoly case has been suspended by regulatory authorities due to active cooperation in investigating and rectifying the situation. Lenovo should submit a written report on the fulfillment of its commitments to the regulatory authorities before the 30th of this month.

Based on the reported clues, the Beijing Municipal Administration for Market Regulation launched a preliminary investigation into Lenovo's suspected monopolistic behavior on November 9, 2017. According to the investigation, Lenovo, as the production, sales, and after-sales service enterprise of the brand's computers and related products, required authorized service stations to implement the minimum resale price for some accessory options and service products within a certain period of time from 2016 to October 2017.

It is reported that during the investigation of the case, Lenovo admitted to the fact that it required brand authorized service stations to implement its minimum resale price control for products in the management process of after-sales maintenance. Recognizing that the relevant behavior had an improper impact on competition, Lenovo immediately took corrective measures such as abolishing price control documents and revising service agreements, and stated that it would further take active and effective measures to eliminate the consequences and impact of its suspected monopolistic behavior.

In July 2018, Lenovo submitted an application to suspend the anti-monopoly investigation and promised to take corresponding corrective measures, mainly including: conducting a comprehensive investigation and verification of whether there are any violations of the Anti Monopoly Law in existing sales and service documents, and immediately correcting or abolishing the content and terms suspected of illegal behavior; Reduce prices for products and service spare parts sold to brand authorized service stations.

The Beijing Municipal Administration for Market Regulation believes that during the investigation of the case, Lenovo actively cooperated with the investigation, had a deep understanding of the existing problems, and proposed and actively implemented corrective measures to eliminate and recover the improper impact of its behavior on competition. The regulatory authorities have decided to suspend the investigation into the case in accordance with the law and supervise Lenovo's fulfillment of commitments. If there is a violation of Article 45 (3) of the Anti Monopoly Law, the investigation into the case will be resumed.
